5:10 pm
let's not forget there are politicians in the mix too in terms of having infidelity and mistresses, and people are, for whatever reason, fascinated by this topic. so i think people will watch the show. >> well, what do you think about this? can you see these controversial women actually being able to redeem themselves on a real tv show? >> i don't know about redemption. i mean i'm always one for people you know trying to do better and trying to recover from a bad situation. but at the end of the day, this whole pius business that he was talking about, i think is interesting. had these women been pius and righteous they wouldn't have a reality show in the works. so bad behavior, unfortunately in today's society, is rewarded. it is rewarded financially, it is rewarded with opportunity. >> midwin charles, thank you. >> thank you. and now we to turn it over to you. we want to know what you think. it is our expect "showbiz tonight" poll. tiger woods and jesse james' alleged mistresses, should they get a reality show? please vote

the blogger has had headlines in the past saying that casey should die. and the blogger gave a shoutout in court, and even gave the blogger a call to wish him well when he was stick. again, judge strickland is off of the case. what does that mean for the murder trial? we will have that coming up. and any time now, we could learn what happened to little haleigh cummings. the little girl from satsuma, florida, who vanished a year ago. a short time ago, her father was told to make plans for the funeral. now we know what the cops found by the river, two cinderblocks. >> you think that haleigh died in this area? >> it is our belief that this is a very real possibility. >> look. >> tommy and joe took haleigh and wrapped a yellow rope around her, and carried her to the dock and tied a brick on the other end of the rope and throwed her into the river. >> i didn't notice about haleigh

from the house, but that didn't lead to anything either. >> again, we are waiting to find out definitively what happened. t the latest story is from flora hollars on the nancy grace show after a conservation with misty thursday morning about a rope and brick tied around little haleigh and we listen to that comment. >> what i was told by misty this morning was that tommy and joe took haleigh and wrapped a yellow rope around her and carried her to the dock and tied a brick around the bottom of the other end of the rope and throwed her into the river. now, that come from misty's mouth into my ear. >> all right. again, that was flora hollars last week talking on the "nancy grace show" and marlaina has she said anything since? she was very talkative? anything since? >> abchutely. she sticks by the story, mike, but contrary to what she is saying, tommy croslin's lawyer

we are following breaking news. florida's most notorious mom, casey anthony, going on trial, and for allegedly murdering her daughter, little caylee, and she going to go on trial without judge stan strictland because minutes ago he pulled himself off of the case. friday, casey's dream team filed a motion to boot him. this drama has to do with some relationship that the judge had with a blogger following the case. the blogger had written headlines like casey anthony should die, and casey is facing the death penalty for the daughter of little caylee's death. and bloggers are writing in saying that the defense will do anything to prolong this case. and others say he was a good
6:31 pm
judge for the case. and mcghee says if he can cause a mistrial, he should go. and a mixed bag there. and joining us is beth kares, from court tv. what did you see in this relationship with judge stan strictland? >> well, he had a communication with the blogger, and the problem is that he initiated them. this is a blogger who the judge said was being very fair. he thought the the blogger researched the facts and thought he was fair to both sides, but the blogger named dave neckle and uses the name marinade dave did take positions periodically in the blog, and one of them was "casey must die." and another one referred to her guilt in that sooner or later, she is a footnote in history when she spends the rest of her life in prison, and so for the
6:32 pm
judge to say, i read your blog and i think that you are fair, sounds like maybe he is saying that i agree with the things that you are saying, and it doesn't matter if the judge told casey to her face, i can be fair, i am a good judge, it doesn't matter what is going on in his head, but what is going on in her head and if she thought he might not be fair, he needed to recuse himself. >> so, beth, as this unfolded, you were not surprised by his recusal? >> no, not at all. we know of two communications he had with the blogger, and the second one in february this year when the blogger was in the hospital and the judge reached out to him afterwards and hoped that he was well. the judge does not even address that in the order. he does say though that the defense was aware for months about the earlier communication done in open court in front of everyone at the end of the hearing and in fact, caught on camera, but a source close to the case told me that these two contacts that we are aware of may not be the only ones between the judge and the blogger. >> okay. a call in, hazel from
6:33 pm
pennsylvania. your thoughts on this development? >> caller: yes, i am. >> go ahead, hazel. >> caller: well, i want to say that the judge should not have resigned. what they are trying to do is to keep delaying this case for all of these simple things hoping that people will mellow out, and nobody will mellow out what she did to her daughter no, way. >> thank you, beth. we have a new judge, belvin perry? >> well, he has been a judge for a long time and i covered a death penalty case with one of the same prosecutors on the casey anthony's team years ago, and the judge sent the person in that case to death row. and he is a no-nonsense judge. i do not believe that the trial schedule will be affected. it is 13 months ago, and the judge has a lot of work to do, but it won't be delayed, i don't believe. >> i want to bring in my colleague, jane velez-mitchell,
6:34 pm
and you see this, stan strickland out and belvin perry out. >> well, it throws a hand grenade into case, and it is chaos. this case would not start until next may of 2011 with this judge and imagine now that they have a new judge to read up on the case, and it is absolutely a bombshell. it really is. i mean, this is the most dramatic development we have seen since the case started. we have seen plenty of dramatic developments. i thought that the judge's motion was absolutely brilliantly written. filled with sarcasm saying basically, you can take the case, here, have it. i will give it to you, like, i don't need this kind of grief. and essentially, his position is that this exchange between him and the blogger happened in open court, and that it was videotaped and everybody saw it and heard about it, and hethe f about it for months and suddenly decided to use it and play this
6:35 pm
card. now, i don't know whether it is a absolutely brilliant move by the defense or an absolutely crazy move that is going to backfire. none of us will know that until we see how the new judge is operating, and whether or not he is going to be as fair as many felt judge strickland was. so, it really could be a brilliant move or it could be a fiasco for the defense. we don't know yet. >> beth, do you see this as a defense strategy to go after the judge strickland like this with the motion? >> well, it is part of the strategy, but they have grounds the do it based upon what they learned. they were certainly displeased with the last ruling by the judge, a couple of weeks ago when he said that they cannot have copies of the texas equusearch documents and they cannot take a pen and paper to go in to look at the notes to or take the documents, but they can look at them and flag some of to documents to be questionable and maybe get a copy. i am told by the lawyers in

welcome back to "prime news" on hln. the police will not charge nfl star quarterback ben roethlisberger in the sexual assault in a georgia nightclub, but he still many believe will be punished.
6:40 pm
any time roger goodell could announce punishment for ben roethlisberger for violating the nfl's conduct code, if you will. and so, what will happen to ben roethlisberger? what should happen? we will take your calls at 1-877-tell-hln. you know the more we hear about some of the details from the accuser, and even without an arrest, it is an embarrassment for the league to say the least, the pittsburgh steelers and now many are watching and wondering if this white superstar, athlete will be treated the same as black athletes caught in past. is race a part of this? call in 1-877-tell-hln. joining us to talk about this is a sportscaster and former trial attorney ellis.
6:41 pm
and it is true that white athletes are treated differently? >> well, it is talked about not just locally, but nationally, about the definitional long different lines and one of them is the racial lines. one of them is the personal conduct policy and the commissioner and how he has applied it previously, so it did not start with ben roethlisberger, but it is definitely something taking on a higher profile since ben's incident occurred. locally, it is of great concern for obvious reasons, because there in the steelers' locker room and speaking to the media the other day, just after the steelers traded santonio holmes, and santonio holmes being an african-american player and only traded for a fifth-round draft choice had a lot of people scratching their hair to begin with, and then the concern of how this will play out relative to ben. so there is a concern locally and nationally. >> well, locally with the pittsburgh steelers, they have done a lot as far as
6:42 pm
advancements for minority coaches, and it is the rooney rule when there is a opening in the nfl, a minority coach will get an interview, and also, the pittsburgh steelers hired an african-american coach mike tomlin to take over the super bowl champs, so talk about that side of it, the steelers and the rooneys and what they have done. >> well, this is not an organization you look at for racial inequity, and for the reasons that you point out with those two examples alone that the steelers have stood for something different through the course of the time, and ownership, and the decades that that has taken place, and certainly, they have had experiences like other organizations with people doing bad acts, but by and large, the steelers do not just pride themselves, but operate under a different standard of expectations, so when you recognize the rooney rool and how it has advanced the sport and has been applied in a de facto way outside of football,
6:43 pm
and other organizations, you understand the breadth and power of that. and clearly hiring mike tomlin who clearly had no head coaching experience. >> okay. let's bring in reverend al sharpton to talk about this. as you watch it unfold, how much do you think that race is playing into this and how much or not? >> well, we have seen athletes in the nba and the nfl and others have seen blacks subjected to some kind of punishment, and i think that a lot of people will see if there is an equal treatment. now, the situation here is that he has not been charged, but there has been some conduct alleged. so, as long as this, it is the same kind of reaction from goodell that we would have seen across the board, race won't play a factor, but if it is seen as different, it will, and the most anyone should ask for is

equal and fair treatment. we should not excuse bad behavior for blacks or whites burk i don't think that we should punish one and not the others. i challenged gilbert arenas when i thought he was wrong, but i don't know that going to jail was required, but in this particular case, there is no charges, but there is clearly bad behavior here. and what is the proper way that goodell handles bad behavior? we will have to see, but it is also the same way he handled bad behavior from black athletes. >> well, reverend, i think he will get four-game suspension and opportunity with conditions and counseling and monitoring maybe down to two games, and if something like that comes down, would you be satisfied? >> i would compare it to similar situations, and if in fact, there is not a pattern of it being different when it is black athletes being involved, then we will have to raise that. again, we will have see what he comes with and match it against the record. the public reaction and there

were a lot of people who felt that michael vick was demonized and race was brought up unfairly at that point, but i don't think that we seek to be unfair to this gentleman, because he is not black, but we also don't want to see an unfairness if there is a pattern that shows anything different, but i don't think that we should pre-judge the pattern. i think that it is correct though to say that a lot of people will be watching, because race was brought up before. race was brought up in vick. >> okay. now, thanks, again. ellis, your thoughts? we expected the decision by, we believe, wednesday, and do you expect two to four games? >> well, i suspect that the league is going to ply this in a way that is heavier than lighter which may give them the flexibility. i think that they are fully aware of the concerns are being discuss here this evening and elsewhere. they are fully aware of the cases to be in effect to punish ben and fully prepare the case to defend what they are doing.
